Terms and Conditions for the Sale of Artisanal Clothing and Accessories in Belgium

1. Introduction

These Terms and Conditions ("Terms") govern the sale of artisanal clothing and accessories ("Products") by Extra Medium Tailored ("Seller") to the purchaser ("Customer"). By placing an order, the Customer agrees to be bound by these Terms.

2. Orders and Payment

Order Placement: Orders can be placed through our website, email, or phone. Customization details must be provided at the time of order.

Payment: Full payment is required at the time of order placement. We accept bank transfers, Bancontact (via Payconiq), PayPal, and cash.

Currency: All prices are in Euros (€).

3. Customization and Production

Design Approval: The Customer must approve the final design before production begins. Once approved, changes cannot be made. This is done during the first meeting before the sale is finalized.

Production Time: Production typically takes two and a half weeks from design approval. This may vary based on complexity and order volume.

Handmade Nature: Due to the handcrafted nature of the Products, slight variations may occur, which are not considered defects.

4. Shipping and Delivery

Shipping: Shipping costs are calculated at checkout and are the Customer's responsibility. We only ship within Belgium.

Delivery Time: Estimated delivery times are provided at the time of order and are subject to change.

Risk of Loss: Risk of loss passes to the Customer upon delivery to the carrier.

5. Returns and Refunds

Custom Orders: Custom products are non-returnable and non-refundable except in cases of defects or errors made by the Seller.

Defects: If a product is defective, the Customer must notify the Seller within 5 days of receipt. The Seller will replace or repair faulty items at no additional cost.

Return Process: The Customer must contact the Seller to obtain a return authorization for eligible returns. Returns must have approval to be accepted.

Circular economy return policy: After a Product is used, the Customer can return it for a credit equal to 20% of the product’s price at the moment of purchase. This credit can be used on any new product by the Seller.

6. Lifetime Repair and Modification Service

At Extra Medium, we take pride in our artisanal craftsmanship and the quality of our products. However, due to the nature of handmade items, we cannot warrant that our products will be free from all defects. Each piece is unique, and minor imperfections are a natural part of the artisanal process.

Warranty Terms

No Defect Warranty: We do not warrant that our products will be completely free from defects. Each product is crafted with care, but slight variations and imperfections may occur.

Lifetime Repair and Modification Service:

Service Scope: We offer a lifetime repair and modification service for our products. This service covers repairs due to normal wear and tear, and modifications requested by the Customer.

Repair Costs: Repairs due to manufacturing defects identified within 365 days of purchase will be provided at no cost. After this period, or for issues not related to manufacturing defects, marginal repair fees may apply.

Modification Costs: Modifications requested by the Customer will be assessed on a case-by-case basis. Fees for modifications will be quoted and agreed upon before any work is undertaken.

Process for Repairs and Modifications:

Shipping: The Customer is responsible for shipping costs to our workshop. We will cover the return shipping costs for repairs due to manufacturing defects identified within 365 days of purchase. For all other repairs and modifications, return shipping costs will be the Customer's responsibility.

Assessment and Quotation: Upon receipt of the product, we will assess the required repair or modification and provide a quotation if applicable.

Completion Time: The time required to complete repairs or modifications will depend on the nature and complexity of the work. We will provide an estimated completion time upon assessment.

Exclusions: This service does not cover damage caused by misuse, accidents, unauthorized alterations, or exposure to extreme conditions.

7. Limitation of Liability

The Seller's liability is limited to the purchase price of the Product. The Seller is not liable for any indirect, incidental, or consequential damages.

8. Intellectual Property

All designs, trademarks, and related intellectual property are the exclusive property of the Seller. The Customer may not reproduce or use these without the Seller's written consent.

9. Privacy and Data Protection

Data Collection: The Seller collects personal data necessary for order processing and delivery. By placing an order, the Customer consents to the collection and use of their data following Belgian data protection laws.

Data Usage: Customer data will not be shared with third parties except as required for payment processing and delivery.

10. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of Belgium.

Dispute Resolution: Any disputes arising from these Terms will be resolved in the courts of Brussels, Belgium. The Customer agrees to first attempt to resolve any dispute informally by contacting the Seller.
